1. Who we are

www.elementformen.com (the "Site") is operated by Element Essentials Men Limited ("we", "us", "our"), trading as Element for Men, a company registered in England and Wales.

2. These terms

These Terms of Service apply when you use the Site and when you buy from us. Please read them before you order. By placing an order you accept them.

They should be read together with our Privacy Policy, Shipping Policy, Refund Policy and Subscription Policy, which form part of them.

Nothing in these terms affects your statutory rights as a consumer. Where any term conflicts with those rights, your rights take precedence.

3. Who can buy

You must be at least 18 years old and buying as a consumer, for purposes outside a trade, business, craft or profession. We sell to consumers, not for resale. We may refuse or cancel orders that appear to be for resale.

4. Where we sell

We sell and deliver to the United Kingdom only. We do not accept orders for delivery outside the UK. If one is placed, we will cancel it and refund you in full.

5. How the contract is formed

Placing an order is an offer to buy, not a completed sale.
The order confirmation email acknowledges that we have received your order. It is not acceptance.
The contract is formed when we send the dispatch confirmation email. If we cannot supply an item, we will tell you and refund any payment for it — no contract is formed for that item.

6. Products

Our products are laundry detergent sheets and fabric softeners, sold in the scents shown on the Site.
We describe our products as accurately as we can. Photographs are illustrative, and colours may render differently on your screen.
Packaging, formulation and scent presentation may be improved from time to time without notice, provided the product still matches its description.
Availability is not guaranteed. Products may sell out or be discontinued.

Using our products safely

Follow the instructions on the pack. Keep out of reach of children. Avoid contact with eyes.
Our detergent sheets are biological — they contain enzymes. Do not use them on wool, silk or cashmere, which are protein fibres. Use a dedicated wool wash for those. This is true of any biological detergent.
Detergent sheets go into the empty drum, not the drawer. Fabric softener goes into the softener compartment, not the drum.
Our products are fragranced and contain declarable fragrance allergens. If you would like the allergen list for a scent before buying, email contact@elementformen.com and we will send it.

7. Prices and payment

Prices are in pounds sterling and include VAT where it applies. Delivery is charged separately and shown at checkout before you pay — see our Shipping Policy.
We may change prices at any time, but the price shown at checkout when you order is the price you pay for that order. Price changes do not apply retrospectively.
Payment is taken at checkout. We accept major debit and credit cards and the accelerated methods shown at checkout, including Apple Pay, Google Pay, PayPal and Shop Pay. Available methods can vary by device.
Ownership of the goods passes to you when we receive payment in full. Risk passes on delivery.

Pricing errors

We take care with our pricing, but errors happen. Where a product's correct price is higher than the price shown, and the error is obvious and could reasonably have been recognised as a mistake, we will contact you before dispatch to ask whether you want the item at the correct price or a full refund. We will not simply charge you more without asking.

8. Promotions, codes and the referral scheme

Discount codes are for personal, non-commercial use, cannot be exchanged for cash, and may not be resold.
Unless we say otherwise, one code per order, and codes cannot be combined with each other or with the subscriber discount.
Specific terms shown with a promotion — minimum spend, eligible products, expiry — apply.
Our referral scheme gives £5 to a new customer and £5 to the referrer once the referred order is placed and not returned. Self-referral, duplicate accounts and bulk distribution are not eligible.
We may withdraw or amend a promotion at any time, but not for an order already placed.

9. Subscriptions

Subscriptions renew automatically at the interval you choose until you cancel. You can skip, pause, change or cancel at any time from your account, with no notice period and no fee. Full terms, including billing, cut-off times, price-change notice and failed payments, are in our Subscription Policy, which forms part of these terms.

10. Delivery

Delivery charges, dispatch and delivery times, and what happens if a parcel is delayed, lost or damaged, are set out in our Shipping Policy.

Goods remain our responsibility until they are delivered to you or to someone you have nominated at the delivery address. If we have not delivered within 30 days of the order, you may cancel and receive a full refund.

11. Cancellation, returns and faulty goods

You have a 14 day right to change your mind on most orders, and separate rights if goods are faulty, damaged or not what you ordered. Both are set out in full in our Refund Policy, which forms part of these terms.

12. Your account

You are responsible for keeping your account password confidential and for activity on your account. Tell us at contact@elementformen.com immediately if you think someone else has access to it. We may suspend or close an account that is being misused or used in breach of these terms.

13. Reviews and content you submit

Reviews must be honest, based on your own experience of the product, and your own words.
We do not pay for positive reviews, we do not write reviews ourselves, and we do not delete a review simply for being critical. We remove content that is unlawful, abusive, defamatory, misleading, off-topic, or that infringes someone else's rights.
By submitting a review, photo, video or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with our products and marketing, including on the Site, in email and on social media. You can ask us to stop using it by emailing contact@elementformen.com.
You confirm that the content is yours to give, and that anyone identifiable in it has agreed.
If you send us ideas, feedback or suggestions, we may use them without obligation or payment.

14. Intellectual property

The Site and everything on it — text, photography, film, illustration, logos, the Element for Men name, product names, packaging design and layout — belongs to us or is licensed to us, and is protected by intellectual property law.

You may view, download and print material from the Site for your own personal use. You may not reproduce, republish, resell, scrape, or use it commercially without our written permission. Nothing on the Site grants you a licence to use our trade marks.

15. Acceptable use

You must not use the Site to:

break any law or regulation;
infringe anyone's intellectual property or privacy;
introduce malware, or attempt to gain unauthorised access to the Site, its servers or any connected system;
scrape, harvest or systematically extract data or content;
place fraudulent or automated bulk orders, or abuse promotions, referrals or returns;
post anything unlawful, abusive, defamatory or deliberately misleading.

We may suspend or withdraw access, and report serious misuse to the authorities.

16. Availability of the Site

We do not guarantee that the Site will always be available or uninterrupted. We may suspend, withdraw or change any part of it for business or operational reasons, and we will give notice where we reasonably can. The Site is provided for information and for buying our products; it is not advice.

17. Our liability to you

We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights under the Consumer Rights Act 2015, and under the Consumer Protection Act 1987.

Subject to that:

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if we both knew it might happen when the contract was made.
We are not responsible for loss or damage that is not foreseeable.
We do not supply products for business use. We are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.
Except where the law says otherwise, our total liability in connection with an order is limited to the amount you paid for that order.

18. Events outside our control

We are not liable for delay or failure caused by events beyond our reasonable control, including extreme weather, fire, flood, industrial action, carrier failure, epidemic, act of terrorism, or failure of public networks. We will contact you as soon as we can and, if the delay is substantial, you may cancel and receive a full refund for goods not delivered.

How we collect and use your personal data is set out in our Privacy Policy.

20. Complaints

Email contact@elementformen.com with "Complaint" in the subject line. We aim to acknowledge within 2 working days and resolve within 14 days.

We are not currently a member of an alternative dispute resolution scheme. If we cannot resolve your complaint, you can get free, independent advice from the Citizens Advice consumer service on 0808 223 1133 or at citizensadvice.org.uk/consumer.

21. Changes to these terms

We may change these terms from time to time. The version in force when you place an order is the version that applies to that order — changes are never applied retrospectively. For subscriptions, we will email you at least 14 days before a change affecting your price or benefits takes effect, and you can cancel before it does.

22. General

Transfer. We may transfer our rights and obligations under these terms to another organisation, and we will tell you if we do. You may transfer your rights only with our written agreement.
Third parties. This contract is between you and us. No one else has any rights to enforce it.
Severance. If a court finds any part of these terms unlawful, the rest continues in force.
Waiver. If we delay in enforcing a term, that does not prevent us enforcing it later.

23. Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in the English courts. If you live in Scotland, you may bring proceedings in the Scottish courts; if you live in Northern Ireland, in the Northern Irish courts. You keep the protection of any mandatory consumer law of the part of the UK where you live.
